Red Lion Chambers is at the forefront of financial services regulation, providing clients with an invaluable range of commercial and practical legal services.
Regularly advising, defending and prosecuting on all regulatory and criminal matters considered by the Financial Conduct Authority (FCA), we have the expertise to assist clients on a multi-jurisdictional basis.
Our ability to both defend and prosecute provides us with a tactical advantage in cases, whereby we can apply our strategic acumen and intellect from a balanced perspective.
Chambers’ members have been instructed in every major FCA prosecution, from Operation Saturn, the flagship insider dealing prosecution in 2012, to Operation Tabernula in 2016, the largest and most complex insider dealing case to date.
Wehave also represented clients in associated Serious Fraud Office (SFO) prosecutions, which arose out of FCA probes into market manipulation by institutions and individuals. The most notable being the global investigations into the LIBOR and the Forex scandals.
We are leading experts in assisting organisations in both complying with and, where appropriate, resisting such warrants via judicial review or private action.
Our expertise in this area means that members' advice is frequently sought by corporations in receipt of FCA warrants during investigations. Many of our barristers also provide training and guidance to commercial lawyers on these matters and related concerns around legal professional privilege.
Financial Reporting Council
Our members are also frequently instructed in major investigations undertaken by the Financial Reporting Council (FRC), the UK's independent regulator for corporate governance and reporting.
FRC investigations generally relate to the professional standards of those within financial reporting, including accountants, actuaries and auditors. These investigations may lead to proceedings taken before their respective organisation's Accounting and Actuarial Disciplinary Board, to which Red Lion Chambers can provide expert representation.
