Jeremy Benson QC succeeds in a Judicial Review of the City of London Magistrates’ Court’s decision to adjourn a road traffic trial

The Magistrates took into account an irrelevant consideration in that they misunderstood the relevance of the authority R. (on the application of Hassani) v West London Magistrates’ Court [2017] EWHC 1270 (Admin); [2017] 3 Costs L.R. 477 to an application to adjourn a trial.   As such, the Defendant was acquitted and costs were awarded.
